Violations could mean no more water

More than $6,000 in watering violations have been charged against the Founders Village Master Association, says a memo from Billie Owens, utilities manager to Don Jones, interim town manager.




The Castle Rock Town Council expects to hear from the manager and others about whether to discontinue water service to the association.




"The town manager is not leaning toward discontinuing water," said Susan Casey, citizen outreach coordinator. "However, it is council's decision after they hear the report."




Since Aug. 25, 20 irrigation violations have been documented against the association, and the association has kept up-to-date with payment on the surcharges, the memo said.




But "customer complaints concerning the ongoing out-of-compliance irrigation are continuing to be received," the memo said. "The situation has therefore not been resolved, and in accordance with the Water Use Management Plan, discontinuance of service is the remaining alternative."




The Founders Village Master Association decided that Environmental Care Inc. did not "properly oversee or maintain] the irrigation system," said a letter to ECI from Mark Eames, the community representative for the association.




As a result, the association terminated services with ECI and retained services with Colorado Green Grass, deducted 10 percent of the monthly July billing for nonperformance and reserves the right to charge ECI for appropriate irrigation work repairs, the letter said.




But the biggest issue, said Aaron Webb, account manager for ECI, was that the irrigation system is old and there were several stuck valves.




"All violations, except one, were on the the same timer," Webb said. "We had the same number of violations in 1999 as this year. But the town changed its policy this year.




"I had to pay those fines, we can't control old valves and didn't bid that amount of fines into the contract. We lost a lot of money this year," he said.




Homeowners in the Founders Village area have been struggling all summer to get repairs made to its irrigation system.




The first warning of violation the association received was May 1 for water on the wrong time and day at the north entrance into Founders Village on Colorado 86.




In June there were four violations: one at Mikelson and Enderud, two at Founders and Lantern and one at the Colorado 86 entrance. In July there were five violations: one behind Prescott, two at Founders, one at Founders and Enderud, one at Founders and Lantern, one at Enderud and Lantern and one at Enderud and Colorado 86.




The association received the most violations in August: one at Enderud and Howe, three on Mikelson, one at Wagonwheel, two at Sandpiper, two at Endrud and Lantern, one at Endrud and Howe and two at Lantern and Cascade.




The first violation was a warning only and no surcharges were assessed. There was a $50 surcharge for the next violation, $100 for the third, $200 for the fourth and each of the remaining 15 violations carried a surcharge of $400.




Representatives from Colorado Green Grass or the Founders Master Association were unavailable for comment.
